Under the building regulations of most German federal states, a construction charge is a public-law obligation of a property owner vis-à-vis the building authority to do, refrain from doing, or tolerate certain things relating to the property.
As a rule, this serves to grant a building permit on a plot of land that would otherwise not be permissible. The owner of the encumbered property enters into a binding obligation, for example, to keep a certain area of his property clear in order to allow the neighbor access to his property (development encumbrance) or to be able to maintain required minimum distances between buildings.
