FAQ from investors: What rights do investors have to the property?

Created by Sukuuk GmbH, Modified on Fri, 17 Feb, 2023 at 9:47 AM by Sukuuk GmbH

The SUKUUK concept stipulates that investors provide funds starting from a lump sum of €250 so that buyers can fulfill their dream home. Until the investment is fully repaid, the investor receives the profit in the form of a specified monthly rent. The investors participate in the property by means of a profit-participating subordinated loan (under German law "partiarisches Nachrangdarlehen"). Your investment is secured by a land charge. In this case, the land charge shall be held by the security trustee on behalf of the investors. The rights of the investors arise from the agreement of the special purpose vehicle (SPV) and the respective profit-participating subordinated loan from the investor. The investor has no obligation to make additional contributions and, among other things, the right to

  • repayment of his investment

  • Profit sharing from the rental payments

  • Utilization of the property under certain conditions (see security trust agreement)

  • Inspection of the annual financial statements
